Luigi De Magistris was born in Naples on June 20, 1967. The son of a magistrate, with a short spell of political commitment by the left spent at College where he studied Adolfo Pansini, then embarked the same career of his father, he enrolled in the law faculty graduates in 22 years, with 110 cum laude, with a degree in criminal law. Even the great-grandfather was a magistrate, and during his career was the subject of attack for having pursued the banditry and malfeasance in the early years of the unification of Italy. Luigi De Magistris from 1998 to 2002 was magistrate at the Prosecutor's Office in Naples then move on as Deputy Public Prosecutor at the Court of Catanzaro. He dealt with cases of corruption in public administration and on the relationship between crime and politics. Among the most relevant investigations there is the investigation of the "Toghe lucane", which directly involved magistrates and police officers.
As part of the investigation "Why Not"-named after a temporary employment company whose business was one of the main areas of investigation--in 2007 the Prosecutor De Magistris has commissioned by police 26 raids against four suspects. In the proceedings of the inquiry include some wiretaps involving talks between the then Minister of Justice Clemente Mastella and the businessman Antonio Saladino.
The Minister Clemente Mastella has demanded urgency pre-trial transfer De Magistris. The Supreme Judicial Council has initiated the transfer of Luigi De Magistris from Catanzaro and functions of the public prosecutor, the day following the resignation of Minister Clemente Mastella. In conclusion both Dale that his aides have been removed from the investigation, effectively creating a national case that did intervene even President Giorgio Napolitano. Dale was acquitted of not having taken the necessary measures to prevent "leak" on inquiry "Why Not" and that he had "casual relationship" with the press. In March of 2009 renounces his Office to enter politics: will the European elections on the lists of the Italy of values party Antonio Di Pietro, also a former judge who repeatedly had earlier expressed solidarity with Daisy. In May 2011 runs for mayor of his hometown, Naples; balloting ends on 30 May with an overwhelming victory: Luigi De Magistris becomes the new mayor of Naples beating the political opponent of the Pdl Gianni Lala with over 65% of the vote.
